Dealers Move to Block Scout’s ‘Unlawful’ Direct Sales Plan That Cuts Them Out Entirely

Shocking that California has nothing better to do... when will mother nature do us all a favor and drop that state in the ocean... I'd feel bad for the fish because I'm sure they'd all have to move because everyone knows that everything in California causes cancer. (Sarcasm, for all of those that don't what that is)

Let me follow up:

Scott Keough released the loveliest holiday greeting message just last week with a very optimistic message of forming community and getting excited about Scouts and then you drop this message about wishing California would fall into the ocean because you don’t like seeing Prop 65 warnings. I’m a cancer survivor and I’ve met other cancer survivors, including a friend in San Francisco who is up at bat for the third time, and this time it’s in her lungs. She’s already lost her reproductive system: there’s no surgical replacement for a uterus like there is for a breast. She spent this year transitioning to her new jobless life and enjoying her new full head of hair and now she’s back at square one wondering if she lives or dies again. I don’t think your sarcasm is as witty as you think it is. There are people in that state other than the ones using politics for their own gain and they deserve to keep their lives. Be as mad as you want about the state’s politics, but don’t make comments about it needing to fall into the sea, sarcastic or not.

As much as everyone is annoyed at California for this tiny little thing that Scout Motors will most likely win in court or they will say “sorry Californians looks like you will have to drive to a different state to pickup your Scout.” to protect them selves from lawsuits. It’s not nice or appropriate to act that way and mention any type Proposition and say “when will mother nature do us all a favor and drop that state in the ocean...” Cancer is a serious illness that shouldn’t be joked about. The reason California has propositions is to help protect businesses and the state from lawsuits from customers.

California also makes it impossible to purchase new vehicles from out of state, by calling a used vehicle as one that has 7,500 or more miles on it. Which basically means to purchase a new vehicle, it has to have at least 7,500 miles on it first.
 
The reason Tesla is able to get away with the "Dealer" problem is because you cannot walk into a store and purchase a Tesla. Tesla obviously read the fine print and realized it hadn't been updated to include online sales. So, to purchase a Tesla, you can only purchase it online, and online only. You cannot walk into a Tesla store and draw up a purchase contract to buy a vehicle. And because of that, Tesla has the loophole.

I don't know if they designed it work the way it does, or by default it ended up like this. But, if Scout does this, then they effectively could get around the law the same way Tesla does.

BTW, I do not think the entire dealer model is bad. I've purchased many vehicles and have had really good experiences. Now, most of the time I'm using the Internet Sales Department, so I don't just walk in a deal with someone. But I understand those if have been left feeling a little irked by the shady salesperson holding you captive.

I wouldn't cancel because it's a dealer model, although I would be very disappointed. When I would cancel, would be if the dealer then does a 'market adjustment' and tries to get more than MSRP. If that happens, then I would cancel my order.
Yes. Market Adjustment is pure Bull Stank. A lot, and I mean a lot of the "Corporate" motorcycle dealers started doing "ADM", or "Added Dealer Markup" for anything that was neat or was expected to be hot. Won't give them the business. The problem in California is you cannot bring a vehicle into the state until it has 7,500 miles. They do this to protect California car dealers. So, you really have to search far and wide sometimes. So, I search far and wide. Or I wait until I find a year old new one. With close to 7,500 miles LOL.

I think you are taking it out of context. Us Californians are sick and tired of the over-the-top regulations. We regulate to regulate it seems. And it seems to only makes us pay more for things. And yet, we still have bad air, we still have some of the most polluted oceans, etc.

One example of over-the-top regulation is the C.A.R.B. requirement for all emission devices to have their stamp on it. It makes products terribly expensive in our state, and we don't exactly know where the 80 million dollars a year the California Air Resource Board receives through their schemes actually goes.

I don’t think I am at all. I get that Proposition 65 chiefly exists because the people who got it voted in hoped to get a Democratic governor elected. I get that the levels of chemicals it’s warning you about are in such trace amounts that there’s pretty much no chance that you’d actually get cancer unless you were going to eat a piece of vinyl. There are things on their list that make perfect sense and things that don’t. I’m not a chemist. You’re sure to find chemists on someone’s payroll who say that some of this stuff is just fine and others that can show you the living or dead people who were made not-fine by dyes in their food or what have you.

I’m all for some rough chuckles, but I personally draw the line when the punchline is “these people can die because this other thing interferes in what I enjoy.” Those don’t have to be your values. We can disagree. I will lose no sleep and I am very sorry if having to care about someone’s air quality causes you this much strife. I do think that some of the things that Prop 65 has brought about has gone too far and that there have been steps taken to cool that down. I’m pretty sure that you can find people in cancer wards who are car mechanics. I’m 15 minutes late to go to my weekly hangout with other cancer patients, one of whom is a guy with a brain tumor from Missouri. His dream was to open his own repair shop and that’s gone because he has a couple of seizures every day. His dad also had brain cancer. I just read something about water pollution from the part of Missouri where he’s from. Can’t imagine that’s related. There’s a glut of people from Buffalo and Rochester, NY who had cancer starting when they were kids because companies like Kodak dumped so much shit into the river.

Believe me, I do understand you. Please understand my side, too.

Common sense is not that common in our state.

California banned the sale of new off-road motorcycles with spokes because the nipples that have spokes had trace elements of lead in them. And they claimed that children would be able to ingest the lead. Madness like this is what drives people crazy.

Common sense is not that common in our state.

Often, it is done just to have more money for their purse strings because of overspending.

Banning seems a bit much, but considering that there's no standard for a "safe" amount of lead in the bloodstream, it's not entirely unreasonable. If there's any chance that lead gets into the air, gets ingested, or is absorbed from skin contact, game over. There's no safe level of lead in the blood. It's not entirely madness. Lead has been found in crazy places, like children's cosmetics and food and enough lawsuits have come about as a result that nobody wants to take chances. I'm not shocked. It does suck and I agree that the people who want new off-road motorcycles shouldn't have to go find a new hobby when a solution exists, whether it's a new material or proving that nobody's likely going to get poisoned.

All kinds of brand new 2025 Honda Dirt bikes with spokes for sale in California, and I would bet the same for Suzuki, Kawasaki, etc...

Too often people greatly exaggerate California regulations to try stirring up outrage.

As a fellow South Carolinian, I would like to think that is true. But I cannot help but note that one of the largest economic development incentive packages in the history of the state was exercised without first remedying Section 56-15-45(D) of the South Carolina Code. The dysfunction of the General Assembly can at times be staggering.

There's time for lobbying to end in a happy outcome, so I'll choose to be optimistic. I'll also plan for the possibility of needing to purchase out of state, just in case.

You good? You’re from texas. A state that is nowhere close to how California is. New Jersey is basically a mini California, so yes I know how Californians feel. I want to leave my state everyday but what keeps me here is the location where i live.

Wow. Amazing so heated over a state’s choices. Just a note there’s a slew of other states who don’t allow EV direct sales and have their issues. Let’s refocus on SM and skip the trashing the various states within our great (and free) country

Too bad that our elected officials (no matter their party affiliation) do not have the enthusiasm of some on this forum, then maybe our elected officials could get something done for their constituents.

Instead our elected officials focus on being social media stars, demagogues and hypocrites who utilize their positions to manipulate the minions by giving them polarizing rhetoric to focus them away from their inability to do their jobs…
